You are very confused. The restriction on Tony Spell's church that we are talking about is a state restriction. I responded to a person claiming that Spell's constitutional rights were being violated.

The text of which further elaborates on my point which is that if the Constitution does not explicitly state the power is granted to the federal government, the federal government does not have that power.

Therefore while the enumeration of the rights to freedom of speech, freedom of religion, freedom of press, etc. doesn't mean we don't have a right to life (we absolutely do, of course), the 10th Amendment clarifies that the government cannot invent the power to enforce those rights unless they have been explicitly granted those powers by the Constitution itself.

So no, you can't just say "we have the right to life therefore the government can just do whatever they feel like and justify it by saying it's protecting a 'right to life'" -- that's just not how the Constitution works, and it is you who needs a civics refresher.


Nobody was talking about whether the federal government has the power to impose restrictions. That's completely off-topic.

I'm certain of three things about this guy:

1. This guy's hair is creepy.

2. This guy would not be a "Pastor" if money was not involved.

3. Jesus would kick him in the nuts.

There's already been one person from his church who died of COVID-19 and others have been hospitalized. Of course there's a clear and present danger.
