There is probably a rule/law that states after so long you much change it as well, or its invalid
Well it says on their website that you have to change it after you get married. But don't know how they enforce that rule.
I just don't see why you wouldn't. At the most it is $100 you pay. If you travel out of the country any...why wouldn't you pay the $100 to know that you won't have any issues while traveling?
I mean....if you have all your other stuff in your married name BUT your passport....that could cause problems if you lost your passport while traveling...cause all your other documentation is in your married name(credit cards, driver's license, etc).

I meant "must". But like a Drivers license, when you move or change name, etc.. you have to change your DL after a certain period of time

yeah, but they don't really enforce any of those rules. Heck where I live, you move, you just write your new address on your old license.

My parents have no idea what they did with my birth certificate so I am still waiting on my replacement before I can get my passport

You should call the airline immediately and see if they will change the last name on the ticket to match the passport. They say they can't change the name on the ticket because you're absolutely not allowed to transfer your ticket to another person, but they can make exceptions to that policy.
Depending on what you mean by "a few weeks" you might have time to get the passport changed, but I'd definitely be worried that it wouldn't be done in time. Granted, in my experience, passport renewals don't take as long as they claim they will, but I could just be lucky. I don't think there is any way to guarantee you'll get it back in time, especially if the trip is within a month. I'd definitely call the airline first, and even if there a charge for the name change, it's better than having your whole trip ruined.

As others have said, get it changed. And a word of warning - the passport office will want an official copy of your marriage certificate. I mailed in a photocopy when I changed my name and they sent it back with a letter to send in an official copy. With a time crunch, you won't want any delays.

Well duh, it is all over the website that you have to send in a certified copy of your marriage license and not just a plain photocopy.

This is why I don't post on this board. Just trying to help. It's conceivable that someone else might miss that, too.

Not if they can read
From the website

Submit Form DS-82 by mail with your current passport, your name change document (original or certified copy), a color passport photo, and all applicable fees.

Wife and I traveled internationally last week. We've been married 4.5 years. Her passport is still good for 3 more years in her maiden name. Just booked the ticket matching her passport and have had no issues.

I'm not cranky. Just pointing out that if you can read and follow basic directions...you won't have anything to worry about.
I mean....who would think a plain photocopy would suffice for a passport? You can't use a plain photocopy for anything else when you change your name so why would you think it would work for a passport.
