Exactly, which is why I wrote "It's not out of the realm of possibilities that he ought to rot at Angola."

Do you believe that it’s ok to charge a 16/17 year old as an adult in some cases?
I do and it’s legal.
So if the USSC wants to retroactively make those crimes committed by someone that should have been charged as an adult free, it should be perfectly legal to retroactively charge the criminal as an adult.

You also wrote something about how black people were treated at the time but didn't say that it was possible the guy just snapped and decided to kill a police officer.

No case is absolute and it depends on the totality of the circumstances, the nature of the crime, his prior history, mitigating circumstances like personal background, family life, IQ level and so on.
Someone like the florida shooter in Parkland would qualify for being charged as an adult.

That smacks of double jeopardy and that's illegal and unconstitutional.

I would agree with you if we were talking about grown arse adults with fully developed brains and minds who made rational choices with their crimes

So it's ok to give a teen life in prison now. But a 17 year old was convicted of a crime and under the laws at the time found guilty and thirty plus years later it's ruled unconstitutional and he should be freed.

No, I wrote it was possible that he should rot at Angola. Did you think that I was implying that there had been a miscarriage of justice, but I thought he should rot at Angola anyway? I wasn't. However, I did make the mistake of assuming that by writing my "rot at Angola" remark that a reasonable person would be able to infer that I was saying it was very possible he was guilty as charged. My mistake.

You can still sentence a minor to life. It's life without parole that was found unconstitutional for minors.
That a-hole who shot David and Nicholas Pence on Clifford St in Metairie was only 17. No death penalty for minors, and no life w/o parole. He was sentenced to life. I think he needs to serve 40 years before his first parole hearing. I doubt he'll ever get out because the murders were so brutal and unnecessary (more unnecessary than usual, if you will), but you never know what can happen. Maybe he'll write some newspaper articles and get out like Wilbert Rideau.
