Explain how he can prove with at least 50% certainty that the owner was negligent. I guarantee he has no documentation from the accident and he's no longer on vacation

I've had a pretty serious herniated disc. Lucky for me, I was young when it happened. I had two separate epidural injections, which basically made a night and day difference. I've returned to a normal, active life. The only things I stay away from are Olympic style weight lifting, the cause of the herniation in the first place. This isn't a woe is me, dear diary, just saying that him playing corn-hole doesn't mean he didn't have a previously injured back.

He was sitting in a chair, which was connected by the owner, or his agent, to property of the owner. The swing failed. Do you think the owner has documentation that he had checked the fixture in the past 6-12 months, or EVER for that matter? Very doubtful.

Very high chance that the property owner has a management company renting out the house, so yes I would not be surprised if there is documentation that the swing had been checked. Also, in civil suits you have to prove its more reasonable than not that the owner was negligent. What evidence is there that the owner was negligent? Not having documentation that the swing was checked isn't going to be enough if this guy has no documentation to show the swing failed.
