That's what id like to know.
If there were building anger issues as the race went on, a motive can be drawn from this. If TS really just lost control and hit him, it will not show motive.
I think this is what the prosecutor will have to determine.

So if I douse myself in gasoline and run up to someone smoking a cigarette and burst into flames, I guess the guy smoking shares part of the blame?

Theoretically, he could have thrown down the cigarette and stomped it out before I got close enough, therefore he shares some responsibility.

I don't follow NASCAR or give a shite about Tony Stewart. As a casual observer, I see where he did nothing wrong. Who the frick knows what his intentions were. The kid did something stupid and just happened to get hit by TS. My wife watched and agreed and had zero knowledge of events prior to watching it. She said that dumbass walked out and got hit.

What if he saw you douse yourself and flicked his lit cigarette at you on purpose just to scare you?

At the moment I'm thinking involuntary manslaughter. No jail time, but civil case will clean TS clock.

No on criminal and no on civil

The facts are:

Guy walked out in front of Stewart's car and was struck by Stewart's car and died.

Everything else is just assumptions that no one can testify too.

Civilly, you can't get past the fact that the guy left the safety of his car and stood in the middle of a race track in front of a moving race car.
