and part of that money was used to take care of their mother during her final days. If there are bills that need to be paid, then they need to be paid. it really looks like you're trying to pull that money out before the creditors can come after it. Then you just tell them oh well. those people worked hard to take care of your mother-in-law before she died. This is not the way to treat them now.

keep in mind that if all of those assets were in your mother-in-law's name at the time of her death, then the medical creditors are really going to fight hard to get what it's owed to them. If you fight them, you can also expect to have to pay those legal fees as well and potentially lose even more money.

I guess the horse is jumping the gate.

I'm just kind of pissed off that the lawyer the family got didn't even try to split monies.

Maybe trying to avoid some taxing authority?

Seems her assets are frozen, bills due need to be paid and remainder goes to heirs.

When they gave her the money it was no longer theirs. If it returns it will follow the natural order of inheritance

do what?

Pay the bills, pay the taxes and split the remaining on the three kids.

What am I missing? This seems quite cut and dry, unless someone is trying to get over on others...

But was it actually given or did she just have usufruct? If usufruct then her estate would have to pay back to the naked heirs, in this case the kids. Correct? And if so who would be paid first?

Dude. Open a succession. The rules are pretty clear. If your MIL had a will...read it. If not....look up Louisiana intestate laws. It could be more complicated if FIL and/or his parents never had a succession. Get a lawyer. What parish did MIL live?
