I had the same problem but it was with my child. I showed up with her to a GI specialist, very important appointment, to find out she was not added to the plan in the time frame.

I stepped out into the hallway, berated the broker over the phone, then handed the phone to the clinic office manager. He just asked that they proceed with the appointment and he would make sure they would be paid.

Thanks for the helpful tips about the Broker’s errors and omissions insurance. They’ve yet to mention that, but I will confront.

So how does it work come the end of the year and I can’t prove my wife was insured? Will I have to pay a huge fine to the feds?

In the future, log on to your health insurance website and make sure your spouse or whoever is added to the insurance. You don't have to just take it on faith that the broker or HR did the right thing.

it doesn't need to get looked at. There are two possibilities. They will prescribe some pain medications. She can get by with otc medicine. Or your wife tore something, which will require mri's. You're going to pay a good bit out of pocket for the mri's and possibly surgery. If you can afford all of that, you/she can afford to get it looked at in the first place.

After decades of hurting ankles, knees, elbows, etc and going to drs, I've learned it doesn't need to get looked at.

I think the individual mandate is gone, effective 2019.

Is this a common thing for the broker to enroll new employees/spouses on insurance plans? Is it just in bigger corporations? I have no idea who did it when I was at a big law firm, but at the two family businesses I have worked for, the broker had nothing to do with it. Maybe our broker would do it but we don't ask because it is really easy and takes 5 minutes

Difficult question because the answer is "it depends".

For small businesses, it sometimes makes sense just to utilize the insurance companies online admin system and enroll them yourself. It doesn't take long and you know it was done and can move on.

In OPs case, it sounds like the broker uses an online system for all benefit lines. That should either trigger a report for the broker to send in the app or for larger companies the info will be sent electronically to the company on some regular interval with little to no human involvement.

If you want your broker to help with new hires they should be able to do that. But for small companies, I would just do it myself because then you don't have to wait on confirmation from the broker that the insurance company has the info they need and the new employee is "in the system".

Whatever expense you incur because of his Error and Omission is the E& O carriers liability. Don’t complicate it. The policy is written just for this.
