O-T lawyers help me out

Some backstory, I've been dog sitting for my girlfriend at my apartment occasionally for the last couple months. He's been around off and on. I've never hidden the dog from management and have even waved at them while walking the dog around. They never left a note on my door, called me, or have even given me a verbal warning about having the dog.

Fast forward to today, I called the complex and let them know I wasn't renewing in May. The manager says that's fine, but now they're going to charge me for a pet that they noticed I have. They're going to charge me from the time they noticed I had it until now.

Why wouldn't they tell me I wasn't allowed to dog sit occasionally? This isn't my dog and as far as I knew they didn't care. They saw me with the dog and never said a word. So what are my options here? Am I stuck paying these frickers, or do I have some kind of argument here?

Have you thoroughly read the lease agreement? It's probably in there. They don't need to "tell" you anything at that point.

Should look at your lease and the verbage around having any pet in your home. I know some leases state that even one day in your apartment can trigger financial ramifications

I'm sure there is something in your lease stating visiting pets aren't allowed.

Unfortunately, it is on you. Also, when you move out they will be looking for pet damage.

I'll need to dig up my copy of the lease somewhere. I'm just curious about the legality of charging me without any kind of written notifications or warnings. If I agreed to it then I'm SOL, and I understand that.

I work in the industry. They don't have to give you any warnings. I guarantee this is all in your lease.

And you better check hard for any damages. They will be looking and how much of a pita you are will determine how hard they look.

Carpet will be pulled back to check for urine.

Make the gf pay. It's her dog.

I guarantee you it's in the lease; they've already "told" you their stance on let's when you signed.

If they were that lenient on pets everyone would say they were "dog sitting."

So you didn't pay a pet deposit but kept a dog at your apartment and are upset they want you to pay for it?

ETA: how should they know if it is sitting or owning the dog? If they see it, they assume it's yours. And you should have spoken to them ahead of bringing a dog into the apartment.

Devils advocate here; you stated when signed lease you didn't have a pet. You've had one the entire time and they caught you. Pay up. Prove otherwise.

As others stated check the lease agreement

Follow up question for ya. How do they determine "when they noticed the pet" without any kind of proof, I.e. A phone call or written warning? They could say they noticed the little bastard 4 months ago when he only first came around 2 months ago.

If pets and related deposits/charges are addressed in the lease then they dont have to give you written notice. Your notice is in the lease you signed. If anything, you may be in violation of lease terms for keeping a pet in your apartment without notifying management or getting prior approval.

I'm not unreasonable baw. I'll pay if that's my only option. I'm just seeing if they can make me pay without providing any kind of proof.

If it's a deposit you will just be charged the whole deposit.

As for pet rent, they certainly made a notation in your file the day it was noticed.

Document, document, document!
