This is dumb and apparently, so are you. Based on that video, there's plenty for a DA to use.

i think his self defense actions were reasonable.

if some stranger repeatedly comes at me and starts a fight with me, i'm not stopping until he is knocked out or incapacitated.

the trucker doesn't know if this guy is going to get back up and come at him again, possibly with a weapon this time.

that trucker did nothing wrong.

it would be bad form to keep beating on somebody if it was mutually agreed upon combat. but that NY punk assaulted the trucker and he was just exercising his right to self defense.

I agree. People can't differentiate a situation like this with the UFC where a ref should have stopped the fight.

The guy definitely hit the guy several times and for several seconds after he was out...and I find that reasonable given that he was attacked.

It would stun you to know just how ironically and ignorantly stupid your post really is.

And I mean that only in a real and descriptively accurate sense and not as a means of insulting you.

You obviously know little about the law to argue that a DA in the South would see just that video and feel obliged to press charges against the victim of a battery for beating up his attacker.

Enlighten me, counselor. Go on...use precedent to illustrate your reply.

From a legal stand point, there is no sensible debate on that point.

There is only the moral issue of whether he should have stopped hitting his attacker 3-5 seconds sooner.

Apparently, certain posters, namely one that has never been in a fight, feel that he should have. Many others feel differently.

There isn't? How so?

Psst...hey...that "moral" issue resides within the law, y'know.

Im thinking the black guy is mentally challenged because:
1. he's calling the white guy n***er.
2. he wants a guy to suck his d**k.
3. he cant master the centipede.

First, that wasn't the purpose of any of my posts in this thread, despite what you asshats keep trying to paint it as. I said that both of these people were pieces of trash and the fight was not necessary at all.

The fact that you said this

leads me to believe your not in the legal community.

While I appreciate your open invitation to further discussion of that issue, I don't see the point really. Each of us seems convinced and comfortable with our position and I honestly don't see the legal implications as being seriously debatable.

Assuming the black guy was helped up eventually and later walked off on his own with no lasting ill effects, this was just a bully starting a fight and getting whipped.

This happens every day without charges ever being pressed. I would bet that most posters here have seen a bar bully get his arse beat badly and then revived and taken home. While I was at LSU, I saw too many to count.

Had the black guy ended up in a hospital (and able to press charges) then some DA might possibly have to at least consider the issue of excessive force in self-defense.
