Depends on if during a severe event such as a hurricane or if not. If not, did the tree show obvious signs of disease. “Strict Liability” no longer applies. If during a hurricane, nobody is liable. If no hurricane, it depends on signs of rot or disease.

You can trim anything without permission that hangs over the property line.
I have lived through this. Actually, not finished with it. Let’s see if i can sum this up:
-when the tree fell, i had to pay for the removal of the portion on my property, and same goes for the neighbors.
-i handle all living/repair expenses with my insurance company.
-my insurance company sues the neighbors insurance. Actually they tried to get me to agree that they were not liable.
-neighbors insurance covers costs not included in my policy. Ex: asbestos testing (my house was built in the mid 50s).
-yes, i am getting my deductible back.
Real life experience. Any other questions??

You. The only way you have a chance at holding the neighbor responsible is if you can prove negligence on the neighbor’s part....such as him knowing the tree was rotted out and in danger of falling, getting a notice from the city to cut it down, but did nothing. And even then its probably going to be more trouble than just paying your deductible

You do unfortunately. Unless you can prove that your neighbor knew that the tree was dead prior to it falling it’s on you.

Thankfully he wasn’t home or he would have likely been killed.
He ended up getting a new house in a new neighborhood so all ended well.
I was very relieved to say the least.

Your insurance handles it. A tree in my yard was knocked over into the neighbor’s yard by a nearby F2 tornado and did some damage. I was responsible for just the part Of tree removal in my yard and what was in his yard was handled by his insurance.
