Yes, it's a felony, and it's a bad law. The law was passed a few years ago as a kneejerk reaction to all the teacher-student sex, but it includes any teacher and any student.
She wasn't his teacher, and she wasn't a teacher at his school. She's in her early 20's and he's 18. This shouldn't be a crime, imho.

I don't know. Alabama has weird laws about what constitutes "over 18". Like tobacco, they interpret "over 18" as being at least 19. Or they did 20 years ago anyway.
