Mother arrested for leaving toddler in hot car while at DCS appointment

Police noted that it was 86 degrees outside, all of the vehicle’s windows were closed and the child was extremely wet from sweating.

According to court documents, the vehicle’s doors were unlocked and the responding officer brought the boy inside.

Arrest me, sue me, whatever, but if I see a child locked in a hot car in obvious distress, one or more windows are going to be broken before the cops get there.

Serious question, if you did something like this and somehow injured the baby ...

Could you be sued?

Needless to say she failed the interview. Hopefully both children were taken away.

Would think more along the line of criminal negligence, as opposed to being sued, but not sure.

If you’re an idiot and break the window next to the kid instead of the front windows, you deserve to be sued

Comparative negligence and sudden emergency doctrine (this one is a stretch though) probably would prevent you from being successfully sued if those doctrines are in your jurisdiction.
