No, he was given the upper range of the sentence for his motivations in the vehicle trespass. The state legislature sets the sentencing range, and the judge considers the circumstances when imposing the sentence. Aggravating factors do not have to be criminal acts. The people of that judicial district elect judges that they think are fair and share their values when evaluating these situations.

This reminds me of that story a year or two ago of that old guy who left his basement open to bait these kids into breaking in cuz there was a string of robberies, then he executed both of them , recording the whole time. He was shouting "see that...your me dying...you're dead"
