My first DUI arrest as a deputy was around 2-3 in the morning. The jail back then used to make the guys blow under .08 before they would release them. At 4pm (over 12 hrs later) my arrestee was still over .35.

I would say this is on par for a case like this. A lot has to be done on both sides to prepare.

This poor girl went out, underage at that, and got intoxicated way above legal limit. The fact remains, under the law, the three young men were considered adults by the law. Madison could not consent due to her inebriated state. All of the men should be arrested and charged with rape. Havent you ever watched the 80's block buster movie "The Accused"?
I can only imagine her mom and dads pain. I dont know to what extent of the law they need to pay, but they do need to pay. Terrible decisions have consequences. Madison's bad decision=Death. Four males bad decision=time in jail

I would say her drinking and being blitzed out of her mind lead to whatever happened in the car then her death.

Look, its a sad situation. People do dumb shite when they are in college and I am sure a lot of people on this board would hate to be judged strictly based on what they did in college

She was underage right? So the bar that was serving her should hold some of the responsibility right? I would assume she had to drink a lot to get as drunk as she seemed to be in the videos I remember watching. Or it might not have taken much to get her drunk, either way I am sure the defense wants the jury to think the bar is responsible..

I don't remember the details of this, but I do remember watching some videos. Why did they drop her off? Whatever that reason is, if it was due to something she was responsible for then they will argue that's what lead to her death. Its a lot more complex than a girl getting into a car with 4 men, they raped her then dropped her off where she was then hit by a car which caused her to die.

The reason I remember it so well was the ASA who told me about the BAC levels had me sign an amended PCR affidavit to upgrade the charge to a felony because the dude was a habitual offender.


Put it this way, at one facility a .356 wasnt even good to set a daily record on intake at the center.

There are even people with a disease where their body creates alcohol. There was a woman I saw recently on a show that's daily BAC was over .325 and she doesn't drink at all. That said, she feels like shes had that much in her system, obviously. When you do this daily your tolerance builds way up.

Its sick.

And yes, anyone driving at that level I can 100% understand upgraded charges. At one point in my life I shouldnt have been able to drive, ever. I just got lucky and was never pulled over.

You nailed it, professional drunk.

Probably explains her dangerous behavior that night. She did everything she could to be a target.
