Why should land in the marsh be looked at any differently from dry land? It's not like these landowners are blocking right-of-ways and impeding boat traffic.
Blocking right of ways and impeding boat traffic is exactly what they're doing. Evidently you haventt attempted to launch at the launch into Catfish lake or Basons marina at the Sulphur Mines. Used to be you could launch,go left, right, straight. Wherever you wanted to go to get to your fishing hole. Now you can only go straight. It's like you've been relegated to a fricking maze that they want you to go through. It's ridiculous

Im talking about a floating camp with spuds,
Or even a houseboat or barge for that matter.
I don't see why people are so up in arms about this, I seriously doubt that landowners are causing a big issue in popular and easily accessible fishing areas.
ETA: My bad, apparently this is happening in SWLA.

So build a gate that doesn't touch the water.

We want to have the "if it floats it boats" policy enacted in the State of Louisiana. This policy is in line with every other state in the United States
You'd almost think Louisiana had a different legal framework relative to land ownership rights.
Oh, that's right, it does.

I'm a SELA guy so I don't really have any experience in those areas but I agree, that is wrong. Landowners shouldn't be interfering with boat traffic and putting up gates, etc. unless it's to block off a small duck pond or something like that. They shouldn't be gating off areas that handle boat traffic.

Then I'll be fishing with my newfound fishing buddies in my back yard. I'll have a keg and a pig in the ground for em.

If your pond is connected to public waterways (which are defined as a body of water that does not entirely reside on your property), then your pond belongs to the public and the public can hunt and fish your public pond. They are not trespassing until they get out of the public waterway and onto your private land.
Haha, lake Theriot is calling you bro, go fish it

I'm actually torn on this because I lease private land AND im a fisherman..and would like to be able to access more spots to fish, but I understand both sides of the argument.
I get both sides of this as well. Personally, I've traveled all over the world and South Louisiana is one of the most beautiful places on this planet. It's nature and serenity are truly amazing. I believe it should be preserved and cherished by as many people as absolutely possible.
But the land owner's rights should also be respected. A solution to this needs to be something everyone is happy with -- but also needs to be enforceable. No sense in altering regulation if it isn't enforced.
Why not simply alter the regulations: If you're fishing - you have access to any navigable water-way. No gates on canals. If you're hunting by land, it has to be YOUR land. If you're hunting by boat, you can't be hunting within the boundaries of private land (without permission). If you're fishing during hunting season and entered a canal posted "hunting area" parcel of land - hunters have right-of-way and fishermen must keep a 1,500 yard minimum distance from any active hunter.
All other land rights regarding trespassing still apply. You can't park your truck on someone's field and start dove hunting... well, you can't park your boat on someone's bank and start duck hunting.
This doesn't seem like it should be *this* complicated.

what if I have a DP-2 system on my houseboat? Would that be ok with you if I parked my camp next to yours?

Have you honestly ever had a problem? Have you ever been fishing in a big canal or bay and been told that you were trespassing?
Me personally, no. So? It's still trespassing, a criminal offense.

quote:well brotha, that's the only thing i'm concerned about. That is exactly what is happening.Wish i could carry a Google Maps streetview camera mounted through the marshes so you could see for yourself. It is simple greed and the states typical cronyism ways and big money oil and gas and landowners pull all the strings in the government as always.

quote:i have absolutely no idea what the hell that is but if i thought someone would travel up a canal onto my lease and set up permanent shop then i would dam off the canal as to not allow tidal water into and out of it. It's really that simple. You as a landowner just want boat access i the marsh and want the convienence to be able to pull right up to your camp in your boat without the possibility of someone parking a camp next to yours.
what if I have a DP-2 system on my houseboat? Would that be ok with you if I parked my camp next to yours?
How about this? Legislation that says fishing only in tidal waters. Would that satisfy you? It would me.
