As an attorney, ive never seen a will be invalid that was drafted by another attorney. I've seen several that were drafted by various notaries, including one notary more than once to the point that I called him to tell him he is really screwing up.

So yes, becoming a notary should be difficult.

I don’t think attorneys are the ones that gave notaries all of the authority they have. I believe you can thank Napoleonic Code for that. I will say that there has been lobbying for a second class of notaries that can only witness signatures, but my understanding is attorneys have blocked that.

As a notary, I don’t have a problem drawing up simple deeds, but I’m also a Landman, so I’m pretty familiar with them. I would never draft a Will, even though I technically have the authority to do so, and successfully wrote one to pass my Notary test in 2012.

I’m surprised at that. Maybe it’s a bigger deal in small towns, but I don’t recall ever seeing an attorney advertising notary services. We generally only notarize things tangential to our normal practice.

I’ve heard that the banks would like to have notaries for their clients, but apparently their employees can’t pass the test.

It’s a lot easier than it used to be. I had to write a will, and the test before me had to write a Mortgage ??. They have since eliminated that portion of the test. My class of 30+ only had 1 person pass the test- yours truly.

The UPS Store might not have them at every location in Louisiana, but they have Notaries there.
