Op, the most important thing they need to do right now is file for an administrative hearing with the dmv. This will allow them to keep their temp lic more than 30 days and put off getting the interlock as long as possible. Go to the arraignment. Plead not guilty. Immediately get with the city prosecutor or da and set up the pti. When your pretrial comes they will tell the judge about the pti. You will have a certain time to get your shite done. You’re looking at 90 days suspension, 32 hours community service and a class. At some point you will have the hearing with the dmv. This is completely separate from anything with court. Then you will have ti get an interlock. That’s if you want a hardship. Or you can role the dice and drive under suspension. Either way. Complete pti and the charges will be dismissed.

Go interview and hire the best DUI attorney you can afford and as quickly as you can. The arrest will have an effect on your driving privilege and that will need to be addresses immediately to avoid suspension.

Don't be that idiot who tries to represent himself. No one in the courthouse appreciates that and you will not have as good of an outcome as with a good and dedicated DUI Defense attorney. If you cannot afford an attorney, then apply for the public defender.

My advice, get a lawyer. Try to minimize the legal penalties. Then tell the lawyer to charge you so much it hurts your soul. Maybe that will remind you to stop driving drunk. Not judging, I did it, and looking back it was soooo dumb.

Unless you really believe you can suppress the charges there’s no reason to hire a lawyer for first offense dui at a .11

I know two different people that dealt with this. One used an attorney and one didn't for requesting the pre-trial intervention. Definitely don't need an attorney for the pre-trial intervention. It will be a lot cheaper without the attorney. I do not know anything about Article 894.

Definitely get an attorney. He might be able to get a reduced sentence based on his BAC.

A reduced sentence ? What do you think this is, a manslaughter charge?
It's either getting thrown out with a good lawyer or he's doing pre-trial intervention program with no lawyer.

Depending on what area he’s in, I doubt it just gets tossed out. He could probably request a class C ticket and pay a $500 fine. Definitely get a respected attorney. Usually cost 3500 or so. Had a friend on PTIP and in Texas it’s 18 months.

First thought is get a lawyer that is experienced with DUIs for that jurisdiction. If your friend is going to handle on their own, try to get whatever information they can about the community service (not all community service is approved), AA classes, MADD class, driving classes, etc. and start that process ASAP. If he can manage to get this done before seeing the judge/DA, they will recognize that he is taking this seriously and won't try to rake him over the coals.

As soon as his fingerprints hit the system, it can be found. There may be very limited information associated with that date, but we see them all the time when we do background checks.
