Pg 2 - A plaintiff files a petition or complaint with the court in stage one of a civil lawsuit, specifying what the lawsuit is about. A petition is made to the court by a petitioner against a respondent, while a complaint is filed by a plaintiff against a defendant.

Apparently the fine folks of Ruston never took any remedial law classes so they took this petition as 100% truth. No one considered the fact that a lawyer, who's looking to gain 33% of a judgement, wrote this.

I would surmise plenty of people (but by no means all) know that, but it's fun to stir the pot and gossip about your neighbors, especially when the gossip is lurid. Did something happen? Cedar Creek has admitted as much. How closely this legal filing describes what happened is yet to be determined.

This is about to be shut down if CC has a lawyer worth his degree, they don't want nor need this shite in papers anymore. Their business is students at $7,200.00 a year, they divide it by 12 so you don't even get a break in summer if you pay monthly.

It will take two to three years for all the evidence to be gathered, for the insurance companies to review and respond, for the parents to hire lawyers and submit financials showing they aren't worth going after etc etc etc,

Some judge will soon seal all correspondence and you will not hear another word about it, CC will carry on and the next big internet story will hit soon and everyone forgets this mess.

One day way down the road there will be a sealed settlement that only the insurance co, CC and the kid's parents know about.

It was fun while it lasted though

A possible fly in the ointment is if the parents turn on one another. "My kid was hardly involved! You should be going after the ringleader, and I'll help."

The following process explains the steps of a civil lawsuit.
Step 1: Consult With Representatives. If you are considering going to court, talk to your potential representatives before filing a lawsuit.
Step 2: File Complaint / Pleading.
Step 3: Discovery.
Step 4: Trial.
Step 5: Verdict.

This case seems to have skipped steps 3,4 and went to 5 with the verdict decided by the people

Definitely deserves fairly severe punishment. When these types of things get swept under the rug it can eventually lead to young adults like Brock Turner with his rape or Ethan Couch with his affluenza.

Duh...of course I'm making assumptions...Ok, I'll finish the sentence since you're hung up on it. If they bullied this kid half as much as said in the lawsuit, they deserve severe punishment.

Cedar Creek issued a response to these allegations in which they said in part, “As soon as the school administration was made aware on May 13, 2021, that bullying was occurring, we took immediate action….Based on school policy, five students were expelled from Cedar Creek.”

Details surrounding the civil and criminal cases of this matter will be difficult to collect due to state laws when dealing with juveniles. We will be sure to update you here at myarklamiss.com and on-air with the latest information on this case as it becomes available.
