I really don't see how they would prove this is pre meditated or even second degree murder. I feel like this is going to fall into manslaughter
Das always try to charge one step up with the intention of offering a plea deal to the rightful charges…..don’t you watch TV?

Liontamer...
.... are you saying that since extreme violence is part of the black community that perpetrators should be held to lower standards of culpability simply by virtue of their skin tone?
Go sit in a corner and think about that.
The Austin's, Iryna's, countless other white names, will NOT stop dying by violence in this country until EVERYONE is held to higher standards.

That's not what I'm saying. That's just my assumption of why they act this way. I'm saying they are going to have a hard time convicting for murder.
Texas definitions:
Murder
A person commits murder if they intentionally or knowingly cause death, intend to cause serious bodily injury resulting in death, or commit a dangerous felony that results in death (felony murder).
Manslaughter
A person commits manslaughter if they recklessly cause the death of an individual. This means the person is aware of, but consciously disregards, a substantial and unjustifiable risk that their actions could result in death.
Yea, the kid is a POS loser and clearly has issues. But, i see this unfolding as manslaughter with some serious time in prison. These were high school kids, he had no prior record, and our country has been extremely weak on crime lately.

I assume this just kind of happened spur of the moment. Is this an accurate conclusion? Or am i missing some facts.
You are missing something significant for sure. Maybe some IQ points?

Is this fixable?
Not under current law, no. The law assumes most people will act civilized and can be reasoned with.
