Requesting a bench trial in a criminal case is a very rare occurrence.

Makes sense. I didn't know that and thanks to you and WestSideTiger. In hindsight the logic of 1/12 vs 1/1 is obvious. If you've served on a jury however that is subject to question, at least from my one experience.

Me saying you only have to win over one is a bit of a stretch unless that 1 is very strong willed. As a trial attorney one of the skills is identifying the juror(s) that you need to target. You have to present the case through their lens.

With deliberate bias, a film maker can make any guilty person appear to have been wrongfully convicted. It's a better story to create doubt than to just leave things alone.

Juries don't just find somebody guilty for the heck of it, especially of murder.

The other aspect is forming the jury and alternates (voir dire?). I'd guess two things: First, it seems the judge has a lot of descretion over the process. So if the judge doesn't have the rule of law as foremost in mind you could be looking at a stacked deck. Second, as an attorney you can really impact your outcome in this phase.

Regardless of thoughts of Chauvin's guilt or innocence, how did his defense attorney allow a tainted jurist? That seems like law school 101.

Anyway it becomes in the end a question if you let the guilty go free, or you jail a (potentially) innocent person. I hate for people or me to feel like justice wasn't served, but the line has to be that we let guilty people walk if the case isn't overwhelming.

This happens all the time. Just look at the overturns on DNA. There are biased halfwits on juries.

Another advantage of jury trial is a judge can keep evidence from ever being seen by a jury. In a bench trial a judge can’t unsee even the evidence he rules inadmissible.

Scott “I’m innocent” Peterson was caught by police just over the Tijuana border with dyed hair, his brothers ID, camping supplies, and $15,000 cash.

So you're saying an innocent man wouldn't do that? I think he was four months under a microscope before being arrested. If I were innocent and felt the threat of being arrested, jailed, and executed I'd consider an escape plan for something I didn't do. Wouldn't you?

You're conflating whatever horseshite you've consumed from 20/20 or some news outlet. Let me say this, I have no idea what happened. But I took the time to read transcripts and listen to audio. Not much, but some. From what I've seen he's not guilty in a court of law.

Did he not appeal? Seems like if the trial was so emotional for the jury a quiet appeal would have worked. So either he hasn't or it failed, should tell you all you need to know.

You can’t just appeal the outcome. You have to argue a procedural fault occurred that affected the outcome. You are also largely bound to bring up complaints that you brought up in trial that the judge ruled against you on.

Bill Clinton would not have been found guilty if he had killed Hillary to bone Jessica Alba.

Amber Frye is not my physical type but obviously takes care of herself. Sexy. Scott Peterson's wife was absolutely georgeous too. Great big smile.

I'll say this just to compare notes for dudes, and the three women on this site please don't give me grief. My experience is I have two types of male friends, both great friends to me personally. Some are cheaters and trivial with their vows. The others are like, "I'm married, I don't do that". Most have been the latter, but I'm still friends with some of the former.
