I’m not, but I don’t think any state suspends or reduces visitation based on failure to pay support.

It hits close to home for me. The court system is a joke, when it comes to child support and looking out for the best interest of the child in determining custody. At least it is in the state of Georgia.

Maybe some of you that believe that everything is so cut and dry, when it comes to things like this, will get your own taste of it one of these days.

This isn't about supporting your children. This is about fathers being robbed while being made to feel like a criminal if a life event happens that sets them back financially.

Yeh idk, I wasn't sure if that was possibly where a disconnect was coming from. I would imagine that visitation would only be reduced upon a judge's decision and it would have to be egregious and idk if money would rise to that level. But as noted, I am not a divorce law expert.

They will if the father is in contempt of the judges order. I don’t know where you are, but if there is a state that has judges that don’t mind being disregarded, I’d like to know.

Thanks, Rusty. My Nightmare is finally almost over. I feel for anyone that has had similar experiences with the courts, though.

Happy for you. I live in an extremely small town and take on cases of many different varieties. Unfortunately, a lot of those are custody related cases and I’ve spent the better part of my career fighting for father’s rights. We just had a big win in a pretty high profile case in Union County.

Then you should appeal because that isn’t allowed in any state I’m aware.

Judges can do a lot to punish contempt, but reducing visitation based on failure to pay support isn’t allowed unless, of course, the judge jails the non paying parent until the contempt is purged and the custody/visitation is impacted by the incarceration.

Glad to hear that there are attorney's out there willing to fight this joke of a system.

I had four attorneys over the years and never actually went before a judge. Never got an adjustment or a review.

I paid almost triple what I should have been paying every month(based on what would have been 22% of my gross income). Every attorney said that it would be easy to get an adjustment, but never actually followed through with a court date.

ETA I should have said "never spoke to or was spoken to" by a judge instead of "never went before".

A judge is free to determine that the father is unfit based on virtually anything. Once that happens, the father can be issued a temporary order preventing him from seeing his child. I’ve seen it happen over $300 in missed child support and for the father having a beer with family that included the child at dinner. It’s completely arbitrary.

That’s terrible and I feel bad for you. Keep in mind that the state is also working in conjunction with DSS. DSS is not your friend and will side with the mother 100% of the time, unless they think they have grounds to remove the child.

Reading this thread makes me realize we need to bring back sharia law in the USA.... look - we tried liberalism... and it just didn’t work out. We should have a referendum. Put a stop to this madness before it goes too far

My son’s mother got tired of the government’s BS and negotiated a private party agreement with me. It felt so trashy having to get a money order for the state every two weeks.

Wrong the stimulus checks weren’t held or taken for back unpaid child support at least not in Louisiana if they had been mine would have been held for 30 days and then released (no I’m not behind actually ahead)

See, this right here is bullshite.

I could understand if the mother doesn't work but if she does, then the father shouldn't pay anything.

I was unemployed for 6 months this year and my kids lived with me during that time. I never received a dime but I didn't file either. Didn't want to be a dick and I didn't need the money.

My ex filed. So we go to court and they tell me I have to pay $1300 a month, mind you I'm still unemployed. The judge was at least competent enough to ask me questions about insurance on the kids which I do provide. So that dropped the payment to $360 a month. Then she asked if I gave my ex any money to which I replied no because they live with me. So I pay nothing.

Now I just started working again and have to re evaluate at the end of the month. So I know I'm about to get reamed because I work out of town.

My ex quit a good paying job to get a lower paying job so she can get on welfare and medicaid or Medicare, whichever one. And has a college degree which I have to pay for.

It's sickening.

I just know I’m fixing to get reamed. Me and my ex came to 3 different private agreements and then she backed out of all 3. She lost her job Dec. 10. I did file the paperwork for child support back in November. We share 50/50 custody and I pay for the health insurance.
