the judge part is right.
but this woudln't go to a jury trial b/c it's not over $50k, which is why $50k is the max they'll ever ask for in these fender benders that have no damage, and the judge will allow them to sue for $50k every single time with no proof anyone was actually hurt. They aren't interested in suing the individual. That would be a bad look b/c plaintiff attorneys are the nice guys and the insurance companies are bad.

If your limits are $15k, that person is getting $15k (well they are getting like 25% of it as the lawyer and "chiropractor" will get the rest).
If your limits are $25k, that person is getting $25k with ease. nothign you can do about it.
If your limits are $50k or higher, that person is getting $50k with ease, nothing you can do about it and the insurance company won't fight it b/c they know the dickbag judge will always side with his buddy plantiff attorney.

They aren't asking for more than $50k b/c then they'll have to have an actual trial with a jury, and they would'nt want to risk jurors with a brain not letting pieces of shite get rewarded with $50k for something like this.
They did however want to move that jury trial from $50k to $100k recently, and you can see why they would want to do that, and now you see why are insurance in LA is so much higher than everyone else.

That’s why you have insurance
