This is 100% a municipality or You problem. You if your pool/trees/shrubs caused the issue. More than likely, there is a broken sewage/drainage pip, which is on the municipality.

It seems to me this - legally - is completely between you and your neighbor. The HOA “approval” is irrelevant.
That said, you could leverage your HOA into helping to influence your neighbor to correct the situation. If you have a good relationship with your HOA admins. They could absolutely help there maybe if you’re not having success 1-on-1 with your neighbor.
I see no way you’d be able to sue your HOA for this, though. Seems like common sense to me that they’re not the problem/issue here.

The entire purpose of an HOA is to prevent the neighborhood from going into decline due to one or two knuckleheads, like the neighbor in the OP, doing dumb stuff, like the neighbor in the OP. If your HOA is looking at plans and issuing approvals, they had better ensure the plans are stamped. Otherwise the approval is not done correctly and there is a genuine risk that something will go wrong and a lot of others' property values take a hit. Just like happened in the OP.
It's ok to admit you simply don't understand the scope of an HOA review.

HOA is only approving architecturally that it works ascetically with the subdivision.
Your local permit office will look at the engineering/code compliance/ordinance compliance.
Reach out to local inspection department for action. Not your HOA.

It doesn't mean it holds up. I see that kind of stuff getting steamrolled all the time.
But it looks like the bitcoin/air crash/etc experts already have this one figured out so good luck to yall and your hilarious subdivisions. Keep an eye on the pool board, I hear the HOA says they can hit on your wife if you don't keep an eye out..

I would treat it as if the HOA doesn't exist. They will get dragged in, but your beef is with the other homeowner.
