Well he admitted to killing her in conjunction with another crime, solicitation. Doesn't that help the prosecutions case?

She was naked, probably about to get him off(hj), he wanted to get it in, she either refused or wanted another 200 and he got aggressive and he killed her when she was naked and said no....end of story....he never completed,that's what put him into a rage to kill her....if her bf knew about it, he should have escorted her to all appts and sat in next room or right outside...she would still be alive...

Yes, but that's not one of the aggravating factors that can lead to the death penalty.

Regardless, they'd also have to convict of first-degree murder, which won't happen unless he changes his story and admits to premeditation.

The victim was a correctional officer or any employee of the Department of Public Safety and Corrections who, in the normal course of his employment was required to come in close contact with persons incarcerated in a state prison facility, and the victim was engaged in his lawful duties at the time of the offense.
The victim was under the age of twelve years or sixty-five years of age or older.
The offender was engaged in the distribution, exchange, sale, or purchase, or any attempt thereof, of a controlled dangerous substance .
The offender was engaged in ritualistic acts.
The offender has knowingly killed two or more persons in a series of separate incidents.



You could maybe use the "heinous, atrocious or cruel manner" verbiage, or "or was an eye witness to a crime alleged to have been committed by the defendant" but both would be a stretch, since that's not especially cruel, and no crime had been alleged at the time.

Not true. They just have to prove that he contemplated it before the act, it doesn't have to be 'planned' well in advance per se.
