Where there is a paragraph A, there is also a paragraph B, to-wit:
quote:
B. For the purposes of this Section, there shall be a presumption that a person lawfully inside a dwelling, place of business, or motor vehicle held a reasonable belief that the use of force or violence was necessary to prevent unlawful entry thereto, or to compel an unlawful intruder to leave the premises or motor vehicle, if both of the following occur:
The shooter wasn't inside the property he was protecting.

That's my point. You posted a statute that contradicts your position that the shooting was lawful and use it as evidence that the shooting was lawful. I can't argue with that.
I don't practice criminal law but I do hope you call one of my colleagues when you inevitably splatter the brains of your UPS driver all over your front porch for making a 9pm delivery.
Feel free to tell me how the part I bolded doesn't make a difference.
Also, coming from the same guy who bolded the first part of that statute (and didn't bother to read or comprehend the last part).
Like I said, I hope you do refunds. And don't worry about that, I would only operate within the confines of the law. Even then, I'm unlikely to shoot anyone. Don't think I've got it in me and my dogs are particularly big and agile.
I also don't use lawyers that graduated in the bottom 10% of their class, so that rules you guys out.
Again, if nola.com can figure it out and not you, you must be a pretty poor lawyer.

Supposedly (I haven't seen it), the surveillance video shows the kids passing on their bikes a couple of times. Coulter jumps the fence. There's a flash, presumably the muzzle flash, after 8 or 10 minutes. NOPD arrives 3 or 4 minutes after that.
From what I heard, the video with them riding the bikes was earlier in the day. There had been a string of burglaries, home invasions, and violent crimes in the area. The neighbor (who had the cameras) thought it was suspicious and pointed it out to Merritt. The video also showed someone, presumably Coulter, walking up to the fence and propping himself up on it to check out the house. This is all earlier in the day, if there's a video of the actual shooting I don't know.
Landry expected something to happen that night and he was most likely awake when Coulter jumped the fence. His dog barked and he went outside to check shite out.
quote:
I don't know if 911 was called when Landry heard the dog barking and saw someone outside, or after he shot Coulter.
He probably called them before going out. They probably didn't send any units until the whole neighborhood called with shots fired.

I was just making the point that even if what you think happened (he snuck up on the kid and didn't give him a friendly heads up) actually happened, he's still pretty much in the right under the law as I see it.
That's pretty much the way you have made it out to be throughout this thread.

Nah, just how to win arguments on the Internet.

Supposedly he yelled something like hey what you doing and the kid was behind the car and started to move toward him and he shot 1 time.
It's dark, you have a kid & pregnant wife inside, you have someone who scaled your locked 4-5 foot fence, that makes a move toward you.
In the span of 15-20 seconds that's alot for a guy who's scared shitless to process.

Especially when you saw the saw guy on video hours earlier casing your house.

As stated many times in this thread I pull the trigger and don't think twice. I would have even double tapped his arse because he would not be coming back for a second visit.

I'm guessing this was the case before he was shot.

I agree. Not everyone has it in them to pull the trigger though, it'd be a pretty shitty situation if you hesitated and the other guy had a gun.
As far as the double tap; you'd be better off with a controlled pair at that distance with a pistol. That's a joke btw, judging by your avatar I'm guessing you know the difference between a CP & DT.

Never should have been brought to a 2nd GJ.

I think saying that they brought it to a 2nd one is probably the wrong way to put it. Orleans selects a GJ on the 1st Wednesday in March & September every year. What they're referring to is that this was the last meeting of the current GJ and they failed to rule before ending the session. The people on the jury haven't changed since the first time it came up.
