Or most soccer moms in an SUV
Or most senior citizens who are too old to be driving
Or dumbasses who dont pull into turn lanes/open medians/know how to merge/etc
Or assholes on crotch rockets going 40 over the speed limit
Or 20 plus people on ATVs and Dirt bikes by
Or people cross 3 lanes of traffic because they missed their exit

it's going the way of cigarettes. Young kids already drink significantly less than any other generation. The writing is on the wall. Booze will be an infrequent, expensive thing in 2 generations.

Or the nonuse of fricking blinkers. Don't know why car companies put em on vehicles.

Anyone who is charged with a DUI based of field sobriety tests, erratic behavior or the feelings of a cop should be handed a couple of million dollars in punitive damages until the state stops doing that stupid shite

Your leaving out the HGN test which is by all accounts very accurate in determining if the person has been drinking. It doesn’t mean the person is drunk. It’s the reason this test is done first in a DWI stop.

In many states you can take the breathalyzer in lieu of the FST if you have a medical condition like bad bsck\knees etc.

From Google AI
Horizontal gaze nystagmus (HGN) is an involuntary jerking of the eyes as they move to the side. It's a key indicator used in field sobriety tests, particularly those involving DUI arrests. When someone is under the influence of alcohol or certain drugs, this jerking motion becomes more pronounced and easier to observe

Subjective opinions shouldn’t be allowed

It's still impaired driving, and is putting others at risk on the road or water.

And so is fricking with the ac or radio or checking your gps. All those are probably more dangerous than driving with a .08 and paying attention.

You just have to love all these alcoholics here deflecting from their behavior and making excuses for drinking then getting behind the wheel.

I am not deflecting shite, all I have said from the beginning is it’s just as dangerous for a texter than someone who has been drinking, but the MADD police don’t want to hear it..

What about first time offenders, should those people receive some grace?

No. Find a ride, another driver, or drink at home. How many others are you putting at risk of harm, injury, or death?

Crappie,
So should people be allowed to text while driving? You don’t consider that to be on an impaired level?

I’ll give you a lot of credit. You have been the ONLY one to take the time to answer that question. IMO, if you have strict standards regarding impairment, regardless of how, I respect that vs only alcohol related.

I'm guessing the OP lives in a large city. How about the millions of Louisianians that live in small towns with no such thing as a Lyft, Uber, or Taxi. You would feel a lot different about the situation if you did.

The majority of the time most offenders dont get caught by law enforcement. Therefore those that are caught need to be made examples of, so as to change habits of those not being caught.
