It is based more on the standard field sobriety test. In Louisiana, if you've gotten to the point where the cop is asking you to blow into a machine, you are under arrest for DUI. The machine only supplements the officers case. For the record, .08 is likely way more alcohol than what you think.

I'm not criminal, but I've been arrested a few times in my life and I always get screwed. I spent 4 days in back in January when someone forgot to walk my bond paperwork to the back. I signed my bond papers on Tuesday afternoon and wasn't released until Thursday night.
Luckily one of the guards back in population actually listened to me, called to check on my paperwork, realized somehow my paperwork was lost, and personally went and took care of it. I was out 2 hours after he checked on it for me

I agree, texting or otherwise manipulating a phone while driving, should merit a substantial monetary fine !

Not really traffic related but I got a ticket for parking the wrong way in front of my house (I guess you can say against traffic). At the time I sometimes worked late and when I got home I just parked my car out front and went in. I parked the same way a few times like this. Never received a warning or anything and one day I went to my car to go to work and saw the ticket. Pissed me off. Ticket was written around 12:30 am.

Yea, I don't buy that. I passed a field sobriety test and still had to blow and blew .09 after 4 beers over a couple hours. The only reason he had for ignoring me doing the field test fine was because I was by a bar. It ended up getting thrown out.
And for the record, .08 is not a lot of alcohol. There are countless charts that show you exactly how much it is for gender and weight, and it's not much.

I don't buy this. The cop cannot arrest you if you passed the field sobriety test. The DUI narrative he wrote i'm sure clearly states you gave XXX number of clues indicating you were intoxicated. If 4 (12 ounce) beers in 2 hours put you over the limit, you are a lightweight.

I don't care what he wrote, all I know is it wasn't enough to have any noticeable effect on my reaction, it wasn't enough to make a case of.
And 4 beers is enough to get someone approximately 200 lbs flirting with being over the limit. I can assure you I'm no lightweight with my alcohol, and that's pretty much my point. The cop was trolling the bar area for people to generate revenue regardless of whether they were actually a threat.

Or if the person refuses to submit to the SFST. Or is too drunk to even try.
Besides, the only person in recorded to history to pass a SFST is in this thread, and yet he was still enticed to do a breathalyzer.

I've passed two of them thank you very much, and the other one I was actually shitfaced. Not really sure how I did it, but something about the blue and red lights sobered me up with the quickness. Those cops let me go.
All of this was when I was 20-21, and I'm not overly proud of any of it.

Doubtful, I'd like to see where it got thrown out and on what grounds. You were over the state per se level which is .08. Pretty tough to get thrown out at that point.
You started out saying 2 beers and then escalated up to 4 beers. Not likely there's much truth to any of your story. I'd like to see the report.
