Lot is 250 across the back, 180ish down sides and runs to triangle shape so it's 75 across in the front.

I am 10' off the back with the back side of my garage.

My contractor submitted the run off plan to the city engineers to review and approve, they did.

Yea it Flows downhill, right, I'm not responsible for him having low spots in his yard and not being graded correctly. He is responsible for his own damn water.

I did. And we left on good terms and I told him I would do everything I could, but his lot is extremely low. When he walked away I could tell he was pissed.

I have done a fair amount of this in Florida and Tennessee... Never in Louisiana. Laws do differ from state to state but personally I would talk to the building officials. This situation isn't unique and they can probably share some insight on what is required and maybe show you some examples of homes that had similar issues and how they resolved the issue. Review the HOA docs. They may have some requirements for drainage from adjacent landowners as well.

It's frustrating I know but I expect you will be required to do something. Easier to do it now then after landscaping and utilities are in.

It wasnt high ground, they had dug a swell through the middle of my property. I have reasonable use of the middle of my property.

Gonna make some calls tomorrow to the city and drainage board. If I absolutely have to, I'll pay to have drainage put in, but trying to avoid that. I won't let it get to a lawsuit though, cheeper to fix even if I win.

So I want to be friendly, but I'm not spending thousands to be friendly.


Put in some shrubs and call it a day. they will soak up the majority of the water.

. That’s important, was the drainage across your lot man made or natural. You’re headed in the right direction avoiding a suit. They suck, expensive and time consuming and really suck when you lose.

I dunno on the swell but either way should have reasonable use under the law.

Doesn't matter though, heard enough and know enough that the law is tricky and it's not worth going to court over. Gonna talk to the city and my contractor tomorrow and drainage board. Also going to talk to the other neighbor as she kind of pulled this with him when he built and he is a lawyer.

But in the end, gonna prolly get my dirt guy out there and pull up some trees(which is gonna piss off one of the other fricking neighbors as she planted them on my property and she thinks they are pretty) and do what we can do to get it draining. Much fricking cheaper to do this now then deal with a lawsuit even if I fricking win.

Pump the brakes just a little. He didn't list a response to his text yet. If the neighbor agree that his property is his responsibility, then all is good.
If he responds in another way, bakers rack upper decker is definitely on the table.

Where did that swale drain to from his yard thru yours?

To help him out, your dirt guy can put in swale ditches on both sides of your property but then your draining your yard and your neighbors yard. Can your neighborhoods drainage handle his runoff also?

If his house has the elevation then he should hire a dirt guy to put in swale ditches on his property lines and turtle back his yard so it drains elsewhere.

I just can’t see how this is your problem besides having a neighbor you won’t talk to. The city and engineers and whoever designed and signed off on all of this beforehand so I can’t see it being your problem.

You got this all wrong.

You need to stand in full view of said neighbor and do the helicopter dick. If he doesn't respond, you establish dominance. It's like the law or something. Hell I had to do it. Now if he responds and has a larger dong than you, well that sucks and you have to comply. Thankfully the guy I challenged looked like someone flipping a light switch on and off and I won.

And this is why when you buy a home you make sure you own the nearby land so that no one builds near you to cause these kinds of issues. Havent moved in yet and already have the neighbors hating you
