You are full of shite.
I've argued with them twice about there stupid arse return policy. How the hell am i expected to return a tux the next day when i'm traveling? If i rent the tux on Friday for a Saturday wedding, how about you let me return it by Monday, instead of having to get undressed the night of the wedding to give to that one person that will go return all the tuxes the next day. As if it really matters if you get it Sunday or Monday. You aren't shipping anything out on Sunday.

If they have your credit card on file, which they most certainly do unless you payed everything cash, you best believe they'll charge your arse.
It may take a few months to process but a company is not going to turn down that money. Sure you could slip through the cracks, but is it worth it to find out for a cheap arse shitty tux?
Eta: Once I left my tux jacket at a bar and some jackass stole it and tried to hold it for ransom. He said "his boy" had it and would give it back for $100. I said tell "your boy" to keep the jacket, I'll pay the late fee on principle and make your life a living hell considering I know where you work.
He gave it back real quick.
