In general, in Louisiana, a property owner cannot disclaim liability from an injury that hasn't occurred yet. Putting up an 'at your own risk' sign is worthless and does not prevent liability if the premises are otherwise defective.

Ha. I'm just fricking around. I would assume that Enter at your own risk signs would at least satisfy some of their Liability. But I am just a layman.
But what technically makes it "defective"? If this is the only case of damage, what leg would the plaintiff have to stand on?

I know someone that got paid damage at a car wash but it was bc it malfunctioned where the cars all starting hitting each other

Meh...you still have to prove the premises are otherwise defective. And my attorney is going to make you work your arse off to prove that.
But Exxon did pay me $13,000.00 in damages to my truck when the machine came off the rack and destroyed the bed of my 4 week old truck about 10 years ago. No questions asked, emailed pictures, got estimate, mailed me a check and picked up the tab for a rental truck for the month it took to fix. I was made whole which was all I cared about.

They'll do everything they can not to, then they'll do everything they can to make their poor minimum wage crackhead they employed pay for it. Despite the signs, they can definitely be held responsible

Had a full service wash wreck my brand new car (first wash ever). Drove it out of the tent and rammed into a parked pickup. Destroyed my hood, grill, etc. Then old mex dude driving jumped out and ran.

Got a manual car wash when I was 17/18 on my Tundra. Few days later I realized there were several ~12 inch circles on the hood, where it looked like the top/glossy layer of paint had been rubbed off.
