Nope, bank is waiting. I just need some numbers and info from the dealer. Bank has no idea who to send a check to or for exactly how much. I showed them the paperwork, but it all has to be verified.
Why is the bank waiting? You've got a copy of the buyer's order with all the information the bank needs. For proof of possession, tell them to walk out to the parking lot and match the VIN on the paper work to your truck. They cut a check to the dealership for "amount due", viola.

Ok. Now I'm starting to smell your bullshite.
In your OP you wrote:

The most important question here that you've neglected to answer that could really come back to bite you and your alleged 800 beacon score in the arse is:
What makes you think they've paid off your trade? If the deal isn't funded, no dealership is going to pay off your trade. So keep joyriding around in their truck for a few months and see where your (bullshite) 800 credit score is when you are done.
Or, just do the right thing and go physically visit the dealership to either resolve the situation or bring their truck back.

It'll say "conditional delivery" at the top of the form. The Buyer's Order you signed may also have the language on there.

I just looked through the paper work, there's nothing about a Spot Delivery.
I signed the papers agreeing to a specific price, term, and interest rate. Everything is clearly defined.
Look closer. Not a dealership in the country would send you home without signing a spot delivery form.

Depends on the dealership. Some will payoff quickly if they have a buyer ready to sell the trade.

If they somehow did, and he really does have a signed purchase agreement contract with specified terms, then he might own the vehicle. Only other alternative is the dealer is trying to scam using spot delivery tactics, which can happen.
OP - which dealership did you get the vehicle from?
Posted on 9/16/14 at 2:09 pm to AnonymousTiger
He doesn't own jack. He'll either pay the dealership for the vehicle if he can't get financing anywhere else or the bank once the contract gets purchased.

I'm not. I've reached out them every single business day since I left with the truck and they haven't returned a call. At some point, responsibility has to fall on them. It's not my fault the finance manager doesn't answer his phone or return messages.
You have to figure that any advantage you think you may have, they have already thought of it and put language in the contract to favor themselves. That nagging feeling you have that you are somehow screwed is correct.
Posted on 9/16/14 at 2:10 pm to CajunInFL
Well, yeah. He will have to pay. But he might not have to return it.
Posted on 9/16/14 at 2:11 pm to AnonymousTiger
True, but it also depends on the language in the conditional delivery form.
Posted on 9/16/14 at 2:13 pm to AnonymousTiger
With an 800 beacon score though (if that's true) I find it hard to believe a CU wouldn't honor the contract. Someone messed up somewhere.

That's what I was referring to. I was using a hypothetical situation where he somehow did not have the conditional spot delivery and somehow actually did have a purchase agreement with real specified terms that was signed. In that unlikely case, he may not have to take the vehicle back (which is what I meant by own it), but he would still have to pay.
I still agree, though, that the more likely situation is that he did sign a spot delivery form.
I also tried to point out that some dealers try to use tactics like this as scams to get higher rates and/or payments.

Yeah, called "Yo-yo" transactions. Hopefully this isn't the case. You'd see more of that with sub-prime customers.

Call bullshite all you want, I don't care. I know the facts and that's all that matters.
They did finance through a credit union and gave me dealer financing incentives. They likely have some sort of relationship with this credit union, don't know and don't care. I got the rebate so that's all that matters.
I called my credit union just now and they verified that the loan had been paid off by the dealer.
What I signed is titled "Motor Vehicle Installment Sales Contract Simple Finance Charge".
I have read all of the fine print, it states nothing about Spot Delivery.
It has the typical lingo about carrying insurance, late payments, early payments, what happens if the loan goes into default, security interest, use and transfer, care of vehicle, things like that.
There's nothing about the potential of the financing falling through and having to return the vehicle.
Now please continue with the jealousy of my credit score. It it makes you feel any better, my girlfriend has a credit score over 800 too. I know this because I saw it first hand when she bought her house.

I don't see why a credit score of 800 is so unbelievable?
Not everybody is a dumbass with their credit

You don't have to sign a spot delivery form, if it's not spotted. Signing a spot form usually happens after hours or on the weekends.
You do get selective pricing signing with a credit union. Being a member of one gets you certain discounts. The rebate is probably the rebate they were offering, regardless of the finance source.

I bet they have a spot delivery form in the deal jacket at the dealership and you just didn't get a copy.

You've just won a brand......new..........car!!!!

You asked for feedback. You received feedback you didn't want to receive, then you turned county.
You've outsmarted the dealer. Enjoy your free truck. That better?
