They initiated the sex. They supposedly asked for consent multiple times. Without them initiating it doesn't happen. I mean, how hard is this to understand? I mean seriously.
But yes, if she initiated sex with them while they were intoxicated, then she raped them. If she asked for consent multiple times moments after Kaivon slumped over and didn't know his address, then yes, she raped poor Kaivon. I know that's what you want to hear

I don't know why he keeps trying to insist they were drunk. Take that back, he's insisting it because he wants to win an argument.
Problem for him is the defendants aren't even claiming it. Out of everything we heard from the defense, the defendants being drunk isn't one of them.

She didn't initiate sex with them. So we don't agree. I don't even agree they were drunk. I don't think Kaivon even agrees he was drunk. That would be news to him. They initiated sex with her while she was unable to legally consent. You're just being stupid at this point and can't admit you're wrong

Even if I give you that, which actually is not “law” as most seem to think, what if the other two participants were Above the legal limit as well?
If drunk people can’t consent to sex, it applies to everyone. Not just people that die.

If someone is too incapacitated to consent then yes, my statement was correct. Fair enough that there no BAC attached but almost .32 weighs heavily that she was too incapacitated.
