I see your point, but I think it’s easy to overstate that.
The jury sees the judge as the only fair, impartial person in the courtroom. Judges tend to react to attorneys based on how the attorneys handle themselves more than what side they represent. It is very true that lawyers who earn the respect of the judge are more likely to earn trust from the jury.
But I don’t think in most cases that a judge can or will put a “thumb on the scale.” I think what you are seeing is lawyers screwing up in front of the judge, repeatedly, and the judge reacting to that.

Just so I understand... This particular case will go to a Grand Jury. They will make the recommendation (their findings are not public) to the DA. The DA decides to proceed (or not), correct?? How does the defense attorney going to the judge to kick out the case come into play? I really want to understand how this works. I'm obviously not a reporter. Nor am I an aspiring novelist, podcaster, or otherwise. Just probably time I dust up on my civics.

I think its just a reporter from some news website who is doing everything to squeeze as much bullshite out of this thread that they can. Most of the posts from them are just rambling nonsense. Basically throw shite against the wall and keep the thread going.

Really out of my element here. It’s been a long damn time, but . . .
I think they can indict noncapital crimes without a grand jury. I think the defense can then force a preliminary hearing at which the prosecution has to present probable cause.
Don’t lean hard on this at all. I am very weak on this part of criminal procedure.

your weak is better than my strong. I read a few JonBenet Ramsey books and was shocked to learn a Grand Jury wanted to indict the parents, but the DA Refused. I think I might have listened to some podcasts about it as well. I suppose after my JD from Google, I could also list a Minor in True Crime podcasts. A lady has to listen to something on her morning walks.
