Most likely. Whatever Judge gets it in Orleans is going to throw it out, but that won't be for several months most likely.

Then awhile for 4th Circuit which will 100% uphold.

Its awhile before it gets to the LA Sp Crt, and by then NOLA will presumably no longer have the mask mandate, but will still have the vaccine mandate and emergency powers still in place.

Yes it might take a while but not doing anything would take a whole lot longer. Ignoring the problem and hope it just goes away is as dumb as thinking if we all just get vaccinated this will end.

Teedy is essentially Queen of Nola right now and she can do whatever she wants. Do people EVER think she will give that up on her own??

I could a universe where the Sp Crt strikes down an emergency power statute that has no end date.

Orleans's is way too open ended.

The City Counsel will then have to and change it.

No doubt. The suit will probably be mooted before it works its way all the way up the appellate ladder. At best you hope for some kind of favorable decision that can be used as future precedent against similar mandates.

Also, there is reason to believe the whole point of these extremely strict mandates was to justify allowing Mardi Gras to go forward, at least in LaToya's mind, such as it is. In four weeks when carnival is over, the mandates may be quickly dropped. And, as much as I support this lawsuit and what it seeks to accomplish, like a petulant child the suit will probably cause LaToya to double down on crazy rules and ideas.

I say great. I hope she does. It will just continue to hurt the people who choose to do business in OP. Those folks need their eyes opened and push back as well. The fact that this petition was done by a bunch of moms and NOT business owners basically tells you how scared they are of retaliation from the mayors office.

He may be. Interestingly though, the lawsuit does not seek a declaration that any statute is unconstitutional, which would require that the AG be served with the suit and an opportunity to be heard.

But the difference with Latoya's restrictions is that they derive from an emergency proclamation issued back in May of 2020, which has continuously be in effect since then (although the degree of restrictions deriving from that order have varied, e.g. "Phase Ta-Two!" ).

Haha, yep. Too many drinks at the Polo Club Lounge will dull your sense of legal process. A nationally recognized constitutional lawyer could probably crush the Nola mandates. But we have to roll with what we've got. At least somebody is doing something.

Imagine how big a petulant child do you have to be, to insist that there won't be any perception that you are being "bullied" trumps literally EVERYTHING ELSE HAVING TO DO WITH THE WELFARE OF THE CITY YOU WERE ELECTED TO GOVERN.

NEW ORLEANS (WVUE) - Stricter COVID-19 guidelines took effect in New Orleans, Tuesday.

Not only are all NOLA Public School students required to be fully vaccinated, everyone 5 years and up are required to have both shots to prove vaccination status, or a negative test when entering indoor spaces like bars and restaurants.

In general you had the we need to go along to get along approach. Basically saying it’s all inevitable so just get the vaccine so we can go on with our lives. Your “general” assumption was that people would be reasonable and that is somewhat true with JBE.

Problem is that folks like Kanter and Avegno always put out the doom and gloom vibe on Covid. Luckily for La (state), JBE only put up with some of Kanter’s BS and reeled him back in (though JBE letting the school vaccine mandate pass even though there was bipartisan support against was total BS). Teedy let’s Avegno run wild and here we are requiring a 5yr to be vaccinated to go to McDonalds knowing good and well that that vaccinated kid is still very able to pass Covid on to everyone in coughing distance in that establishment. You might ask why Avegno would even allow the testing option (given her thoughts on the unvaccinated) but then you realize that her politically connected husband just so happens to work for a company that provides testing options.

Surprise, surprise... Judge Johnson denied the plaintiffs' request for a temporary restraining order last week.

It appears that the plaintiffs intend to seek emergency supervisory writs with the Fourth Circuit and LA Supreme Court regarding Judge Johnson's ruling.

Also, Landry's office is intervening in the lawsuit.

Bump

The trial was scheduled to start this morning, per the court's order in early March continuing the trial to 4/7/22 at 9:00 a.m.

I haven't seen anything in the docket following that order. Does anyone know if the trial went forward today?
