On second thought - I withdraw my help and you should go to jail on this alone.

I'm saying a blood test would be able to differentiate between xanax metabolites and xanax you were or weren't under the influence of at the time.

If I had known this I would have given them the blood.

No it was the name given to you in her earlier reply to your question and the attorneys don't have to work in Medina County if their license in Texas they can handle it and probably those in Bexar will know the judges just as well

You do know drugs do not stay in your blood for weeks right? I saw benzos mentioned and they only stay in blood up to 24 hrs. If you had not had a drink, you should have given the blood and not had to deal with this hassle you're about to go through.

I would have had to go though it regardless because I was arrested before they asked for the blood.

Use my cell phone to call and Uber from TX to LA when I’m sober? Smart idea chief.

Not sounding disrespectful, but you probably will beat the charge but not the ride obviously. If what you say is true and I have no reason not to believe you , your going to be ok in the end

They have a motorist calling him in, a failed field test and declined blood sample. What does he have going for him?

Lack of actual physical evidence.

Clean blood test would’ve been a game changer for you

This. She does this work exclusively. I am sure she knows someone in Medina (I see now it wasn't Bexar county) if she can't handle it herself. She runs about 3K all in usually.

By that standard every declined blood test would get off - you aren’t in a great spot here unless they messed up the field test somehow

I hope you get this taken care of..did you ask to take a breathalyzer or was there no suspicion of alcohol? A good lawyer will be a able to provide scrip and talk to DA About reduction noting that you when probably not advised correctly on rights and consequences when representation didn’t show.. not a lawyer but been through a similar situation many moons ago that resulted in dropping of charges. Wasn’t Texas though

Field test are subjective and it’s all on video. Like I said, I have no idea how I failed it. I didn’t stumble, didn’t move my head with the pen, held one leg up for a 24 count. I’m still trying to figure out how I “failed” it. Not to mention any lawyer worth his/her salt should be able to contest the conditions in which the test were given, especially considering I was given another eye test just prior by the county officer that I was told I passed.

Yes, I did ask for a breathalyzer. Also, I didn’t say no to the blood test, I simply asked to speak to legal counsel before doing so.

I was also not read a Miranda warning, but I don’t know if that matters much.

Do your own work, but here you go LINK

Super responsive and she basically will tell you you are fricked if you are. That is what you need. Don't frick around with firms like Dunham and Jones who talk all that shite and don't deliver. Paul is an old Catholic High graduate who says he will personally represent you, but he is the Gordan/Morris version in the DUI world in Texas. He signs you up and you get some frick who can't cut litigation anywhere else.
