That doesn't sound right and I would be willing to bet that the property owner cannot hold him to that. From what I am gathering he signed a lease online which he thought was just a form to run his credit and background. With no physical signature no deposit money collected I say just call the property owner or complex up tell them that the kid misunderstood what he was agreeing to online and try to settle it that way. I would imagine that if no deposit money was collected and the kid did not go to the property and view it and sign an actual lease that no reasonable judge would hold the online signing as a binding agreement. Not bright on both parties here.

Who would be stupid enough to not collect a deposit at the time of signing the lease. Also who would be stupid enough to sign a lease online ,and not go look at the place that they want to lease? E signatures may be valid ,but it would fall on the property owner to bring him to court and pursue this. I just think it is stupid on all parties involved.

If this is a student housing apartment, chances are the security deposit was waived. Also, before you e-sign any form of lease online there is always a declaration page that says an e-signature holds the same weight as a pen and paper signature. So clearly he overlooked this page. His best bet is to say he thought he was filling out part of the application, not the lease.

A lot of apartments around town are doing move in specials and waiving deposits, to those screaming about no deposit paid.

He did look at the property and fill out an app in person.
Only paid an application fee and they ran his credit.
They emailed him a link to a lease agreement.
He just went through and signed everything thinking he would have to do it on paper when he paid his deposit and first months rent.
Instead, it was the actual lease agreement.
So he signed it, but he hasn't paid them anything besides the app fee.

Okay that is more to the story ,but my advice would be just tell him to honest with them and try to work it out face to face. He is a kid and made a mistake and I am sure that may go a long way. I doubt these people are going to put up a fight about this. No deposit no rent check he will lose the application fee ,but that wouldn't be a biggie I guess. It is sketchy to me too and I doubt these people would take him to court.
