auto insurance question

Got rear ended last week. Filed a claim against the guys insurance company. Insurance company is stating they aren't going to honor the claim due to the driver was an excluded driver on the policy.

So am I shite out of luck and have to file against my auto insurance?

Sounds kind of like bullshite, but it's exactly what I'd expect an insurance company to do.

Had this same thing happen to me in January. My insurance got my deductible back from his and I got a check in September.

File against your insurance company and get your insurance company to go after the policyholder for the deductible

If you have uninsured / underinsured motorist coverage, it would apply here obviously. Comp/collision on your car will cover any damage to your car if you don't. If you have only liability coverage, your only option is to sue the person who hit you directly--if they have any assets worth attaching/collecting. You could also name the insurance company as a party defendant. Depending on the nature of your damages, their insurance company may make a business decision to resolve your claim rather than fight it (assuming you're only talking about a few thousand dollars of property damage and not a personal injury component).

hopefully, you have uninsured motorist coverage...in any case, turn it over to your insurance and let them subrogate against the other driver, car's owner, and car owner's insurance. you are the last one on the list that should have to pay anything.

This...unfortunately this will be an uninsured motorist claim. Your insurance carrier should not hold it against you and will try to recoup the monies.

Uninsured motorist is for medical if you have injuries


It's a collision claim then hopefully your insurance company with recoup your deductible

Right, for the UIM coverage it is for injuries...for the car it defaults to collision coverage but it still goes down as an uninsured claim. Splitting hairs at this point.
