If you can't see how a bunch of defense lawyers and insurance companies telling other members (that include advertising attorneys) how they can market their company isn't against the 1st amendment, then that's just sad. Lawyers are supposed to defend the right to free speech, not suppress it.
The advertising attorneys that do not do well for their clients will be weeded out by poor client service, just like any other business.
Others in the profession will throw around words like "unprofessional" and "ambulance chaser". Why? Because they are jealous that others have capitalized on marketing and they have not. If you missed the trend several years ago, then sorry but don't hate. Figure out a way to market yourself.

I get it. Maybe I should have added non-advertising plaintiff attorneys. You can't deny that the defense side doesn't have a few dyed in the wool company men that believe this too.

"Figure out a way to market yourself"? Not hard. Put up billboards all through out the "wrong side of the tracks", make deals with chiropractors & help them put up billboards in the same areas, stand up on top of an 18 wheeler, large check in hand, and shoot all the tv ads the market will handle, proclaim loud & long that you are out there representing the little people, forgetting to add just how little they actually get from a settlement check, stack the legislatures with plt attys who continually vote down tort reform. To name just a few ways.

I suppose if it keeps up the way it is, we will all keep paying higher and higher insurance rates, more and more lawyer billboards will go up, and the wealth transfer will continue.
Who has a vested interest in stopping the silliness that is the 'fender-bender' racket?
TV Stations make money, insurance companies make money, defense attorneys make money, chiropractors and other medical people make money, billboard companies make money, the plaintiff makes money, the 'trial lawyer association' makes money, politicians make money from contributions.
It's just you and I who pay more and more and more. Those billboards and TV ads are not free. They are coming out of our insurance premiums. Insurance companies do not lose money. They set their rates on claim experience and losses.
So next time you write the insurance company a premium check, you are paying for all that crap - litter actually - that is billboard lawyer advertising. And the TV ads.
