remember Amherst College student "John Doe," who was expelled for sexual misconduct, even though he had good reason to believe that his accuser had actually assaulted him? A judge recently blocked Doe's attempt to subpoena his female accuser's text messages on grounds that re-litigating the matter "would impose emotional and psychological trauma" on her

Judge is basically saying "frick the constitution".

posted about this yesterday on the poli board

the scary part is that this isn't one of those on campus kangaroo courts

this is a state court and a civil suit with rules of procedure and due process requirements

Can't wait for SFP to get up in this

Universities are now set up to deal with these situations in this manner these days. The guy has to prove his innocence but isn't given the resources to do so. It's sad that dads have to give their sons this "talk" these days.

There's nothing in the constitution that says you can rape. Judge made the right call.

the 2 biggest fears i have with progs is their attack on due process and their attack on free speech

i THINK speech is more important/scary to me, but i'm not sure anymore

Exactly. It's bad enough these colleges are refusing to give guys due process. But now if the real courts can do it... that's truly terrifying. I just hope this guy can appeal this.

he's suing the school for kicking him out

the kangaroo court of the school already ruled and kicked him out

this is in big boy court

the article even goes into detail about how his best recourse is to add the girl to the suit to compel this, which is going to do wonders for her mental state i'm sure

Is he trying to get the number and time of these text messages or the content? Would imagine the latter us much more difficult.

if she destroyed evidence that could be used in his favor, he could have a spoliation argument

which would basically give him a slam dunk case against the school
