I’ll see if I can find the briefing and video of the hearing from Twitter but basically Reynal’s paralegal sent the entire phone via DropBox. Plaintiff lawyer notified Reynal it may be stuff he didn’t intend to send and Reynal simply replied “please disregard, I’ll send you another link”. Texas code says you have to identify specific docs and specific privilege and Reynal didn’t. Once ten days passed it was fair game.
This all happened within two to three weeks of trial. My guess is Reynal was swamped with other trial prep and just missed the statutory requirement to assert specific privileges over specific docs and thought the general response of “please disregard” would suffice.

Accidentally sending a letter or something that wont blow your case up would warrant "please disregard". Sending opposing counsel your client's entire cell phone he should have been calling Plaintiff and getting confirmation that it was being deleted. The dude is just a clown.

The damage does not have to be financial. People are awarded non-economic damages (e.g. pain & suffering and mental anguish) all the time. You may not agree with that system, and that’s fine, but that’s an entirely different discussion.

Let’s say I own a local news station and I run a segment reporting that you’re a kiddie diddler. I know the report is false, but I publish it anyway. You wind up losing your job because of it. My news station didn’t fire you, your employer did. I didn’t tell them to fire you, I just told everyone you’re a kiddie diddler. So does that mean my news station is off the hook? Of course not.
Now let’s say you don’t get fired, but you become a pariah in the community because of the false accusation from my news station. People hate you because they think you’re a child molester. Someone throws a brick through your window. Just like the first example, those people are the ones who decided to hate you. I didn’t tell anyone to throw a brick through your window, I just told them you’re a kiddie diddler. Does that somehow mean my news station is off the hook? Again.. of course not. I knowingly published a falsehood about you that damaged your reputation.
It doesn’t matter whether the guy who threw the brick gets charged criminally. I’m still at risk of being sued for my false statements.
And again.. Alex Jones could have had his day in court. He could have argued that his statements had nothing to do with the harassment that the families received from those lunatics. He could have even argued that his statements were true (which would have outright nullified the entire lawsuit, as truth is an absolute defense to defamation).
He didn’t argue any of that. Instead, he outright refused to turn over documents despite being ordered to do so by the court multiple times, until the court awarded the plaintiffs a judgement by default. Apparently he thought that complying with discovery would be worse for him than the actual judgement, which is kind of amazing.

I don’t think Reynal realized the extent of what was sent. Apparently it was gigabytes of info because the judge allowed him to go back and claim privilege over some docs and she gave him a day and he was whining that there was no way he could complete it all in one day.

Good, the relentless smearing of the parents saying they were in on killing their kids and essentially directing nutcases to make their lives a living hell (more so than it already became after losing their kids). I’m definitely against any sort of regulation of speech but this goes beyond that and I have no issue with him being forced to pay for the damage he did to those families.

He knew what he was saying wasn't true, kept pushing it and then chose to ignore the court orders and not fight it. He is in this position because he chose to be there.
