Ambulance chaser does not equal med man attorney, med man cases are hard as hell to win.

OP, no you don’t have a case, even if you did there are no damages, you are fine, they aren’t going to give you money for a few hours of pain

There is a cap on medical malpractice damages in Louisiana. If your costs have gone up since the late 70s it was not because of ambulance chasers in the medical malpractice arena. Cases are too expensive to work up and not worth the risk for that reward.

I appreciate all the responses (mostly).

I am not a doctor or lawyer, I also do not need the money since I had met my out of pocket prior to having the surgery.

I was just asking because I thought the ER doctor and doctors after I was admitted to the hospital were very reckless with their care for me

I don’t know if they need an entire team of doctors to speak out but the attorneys need at least one doctor to come out and say there was clear medical malpractice and this almost never happens. Even cases where the patient passes away mostly go unpunished.

How were they reckless? It sounds like they provided appropriate care.

But don’t listen to me, I just read a lot of emergency medicine doctor blogs.

I wish they could make Morbidity and Mortality conferences open to people who think physicians are overly protective of other physicians.


Has it happened in the past? Almost assuredly.
Is it the rule or the exception? In my experience, it’s the exception.

"The system is rigged. A team of doctors determines......" The plaintiff atty hies his own medical expert, the defense hires his own expert, and then an independent physician is brought in. The biggest problem, for plaintiffs, is that most if not all plaintiff attys use call screeners to "weed out" those claims that are not of a big dollar potential: so much for representing the little people.
