How do you figure? Did they need to do something to stop the bleeding? Sounds to me like if you weren’t such a pussy, you could’ve stayed home and been fine. But no, you wanted that sweet-sweet morphine. Grow a pair.

Then they said I had internal bleeding around my liver possibly from being “nicked” during my surgery the week before, and admitted me.

So you had a hematoma, or an abscess? How did they come to the conclusion you were “nicked”? I’m assuming they did the CT with contrast, did it show active bleeding (whole point of contrast)? But that also wouldn’t show how you ended up with blood or fluid around your liver (cause). We’re you diagnosed with Barrett’s esophagus? The liver is not in really close proximity to esophagus so I find this strange. You may have a case, but more info is needed.

For what? Pain?

You signed a consent form prior to your surgery saying you understood that there may be pain afterward.

And yes, sometimes surgeons nick arteries. Did you suffer any permanent disability from this?

Uhhhhhhh?

When surgeons “nick” arteries people die. Fast.

Do you understand the difference between an artery and a vein?

OP should have been in a wreck with a big truck on the way home from the hospital. Then he could Get Gordon.

I'm sure you can get a lawyer total your case, it will go before the review panel, and based on "your facts" I would find for the Doctor. I've been on a lot of review panels.

Sorry you went through all of that. But a bad outcome does not equal malpractice. These known risks/ side effects were likely covered in the informed consent form you signed pre-op. Doesn’t cost you anything for a potential lawyer consult, so if it makes you feel better, go for one. Hope you feel better.

Do I have a case here??

You would have to establish that there was 1. A breach in the standard of care and 2. Proven harm.

Neither of these things occurred.

It sounds like you were admitted for serial abdominal exams and then released once it was determined you would be ok. This seems like appropriate care given your presentation.

Holy crap - do you know how many of my friends have had messed up c-sections giving birth??

The anesthesiologist messed up my epidural for one of my kids and I had to stay in the hospital for a few extra days. I still have ringing in my ears from it - 9 years later.

We all signed stuff saying shite could happen and it does. None of us are any richer.

You can talk to an attorney but the chances of you winning a medical malpractice case are slim to none. Doctors and hospitals are well protected these days.

No case, sorry, but you probably just had a stitch rip the muscle, could be anywhere, but most likely if they closed the hiatus of the diaphragm, more so than the wrap, but post op bleeding happens. The difference is the muscles are relaxed under general anesthesia, but once functional muscles tension occurs after you wake up, voluntary breathing and swallowing will pull at those stitches , and they will rip through the muscles and bleed. They didn’t leave you bleeding, and just close up.....this stuff is a normal complication of this surgery, and hard to prove any malpractice with symptoms 8 days later

The game is rigged, it is nearly impossible to get any type of recourse against a doctor. Want to complain about a doctor? A team of doctors determines if the doctor was out of line. It is the police investigating the police. Politicians investigating the politicians. Same shite, different title.

Not ANTI doctor, anti fricked up systems.
