200 is perfect for brewing, but McDonald's and Starbucks, et al serve it way too hot. It could be the best cup ever served, but it's useless if it burns my tongue on the first sip.

But she got very fricked up by it and only original sought $20k to pay her medical bills. She ended up only being awarded $640k, not $2.8mil.

140-150. McDonald's was keeping their coffee at around 200 degrees because they found if they cranked the temp, it smelled stronger, leading to more coffee sales. Also, Stella was only awarded what McDonald's made on coffee sales alone per day at the time

Still excessive. Yes the coffee was too hot but she spilled it.

And if it were a safe temperature, she wouldn't have been severely burned by spilling it.

quote:

Liebeck was taken to the hospital, where it was determined that she had suffered third-degree burns on six percent of her skin and lesser burns over sixteen percent. She remained in the hospital for eight days while she underwent skin grafting. During this period, Liebeck lost 20 pounds (9.1 kg) (nearly 20% of her body weight), reducing her to 83 pounds (38 kg). After the hospital stay, Liebeck needed care for 3 weeks, which was provided by her daughter. Liebeck suffered permanent disfigurement after the incident and was partially disabled for two years

True but who spilled it?

Liebeck died on August 5, 2004, at age 91. According to her daughter, "the burns and court proceedings (had taken) their toll" and in the years following the settlement Liebeck had "no quality of life", and that the settlement had paid for a live-in nurse.

She died at 91, most people won't get close to that age.

Im pretty sure it burned her vagina to the point of being useless

So yeh, I might live to be an old age but I will consider my quality of life pretty shitty if my penis is burned off

It doesn't really matter. It was given to her at an extremely high temperature. There should be a reasonable expectation that by spilling it, it's not going to severely burn her vaginal area. Had it been given to her at a safe temperature, there are no burns.

This has absolutely nothing to do with anything related to the facts of the suit.

Exactly but for her daughter to say that, GTFOH.

So if I get hurt in a crash, I sue the auto maker? Get shot by a gun, sue the gun maker? Get a paper cut, sue the paper company? Whether the coffee was hot or not, she caused the injury to herself. I'm not saying McDonalds couldn't have done more to help with this situation but you know as well as I do, it is all about making money, not spending it. They still serve their coffee at the same temperature.

The documentary "Hot Coffee" is a pretty good watch about the McDonalds case

I watched this, it was pretty good. It was an accident (self-induced) and you feel bad for her but not for the amount of money awarded. Even the reduced amount was frivolous.

That’s was probably part of it, but I think the main reason was because if they kept it hot enough customers inside the store would have to wait for it to cool off before drinking it leading to less customers asking for refills before leaving.
