He has a right in the sense that he can't go to jail for saying it. I don't think anyone is suggesting that he be arrested.
But, if he says that Brees is addicted to pain killers and Brees' book sales, endorsements, etc. drop., Brees could sue him for slander. And obviously, his "right to say it" doesn't protect him from being criticized.
