And is being sued by the family for wrongful death.
He had to have been looking at his phone. Terrible.
As a reminder, always keep your head on a swivel when crossing a street, especially a busy one. It's your only chance to avoid a drunk or distracted driver who doesn't see you.

I'm going to assume it happened in California.
They have a law there where the pedestrian is always in the right, no matter what. They can be jay walking (which is legal in all cases) or whatever, if you hit them, it's your fault
And the people know that and will step off a sidewalk or into an intersection, head down looking at their phone, and never check up. They'll keep a block long line if cars waiting to turn as they take their sweet time getting to the other side of an intersection. One of the most maddening things about the place.
