The court ruled that the judge in the New York County trial prejudiced Weinstein with improper rulings, including allowing women to testify about allegations that were not part of the case.

I'm not an attorney, but this seems like something so obvious that you shouldn't do that it could have been done on purpose to get this later outcome.

Yeah, that seems like a no-brainer from a legal standpoint almost to the point of being egregious.
I've always contended that most of what Weinstein did was consensual with women who were playing the "tit for tat" game and trying to make it in Hollywood, but there is also likely plenty of legitimate stuff they could pin on him in terms of sexual abuse. Some of these things should be slam dunks against him, but it seems like they can't even do those right.

His greatest crime was being the sole reason many female characters are written so poorly these days.

Or just another layer of insurance in case things didn't go his way. "If all else fails, at least we have this" kind of thing.

quote:That would be the case if the Defense didn't object to the women's testimony. But they did object. The judge overruled those objections. Sounds like the Defense did their job, the judge didn't. Unless y'all are saying that this was the judge's plan to get Weinstein off.

allegations of prior bad acts
I don't know what the judge was thinking, this is law school 101. You can't influence the jury by convincing them he's a bad person.
quote:
prior bad acts cannot be introduced into evidence in a criminal trial for the purpose of showing the defendant’s propensity, or inclination, to commit the crime charged;
And it appears it was used for such purposes here.
