Ward was almost hit by the car before Stewart, without flinching, and then never moved an inch when Stewart hit him. All of this after the fact that he actually got out of his car and walked into the middle of a racetrack. It is impossible to tell from a cell phone video at that angle what exactly happened. Guilt must be prven beyond a reasonable doubt and all that crap. Will never know if Stewart did it on purpose or even tried to scare him. I think he was trying to scare him with 100% certainty in his mind that the kid would jump out the way, but what we all think is irrelevant.

For the most part probably, but i still think there are people that think its ludicrous at the notion that Tony may have had some malicious intent. Facts are very light shades of grey in this case. I have a feeling he may get charged with some type of negligence and it got to trial.

No one is saying that from what I've seen. Just simply saying there isn't any proof that there was malicious intent, which there isn't.

If you have a clear video that shows entire event, you poll all the professional drivers and ask them if there was intent of Tony Stewart to scare or intimidate Ward, i know where i'm putting my money on the majority answer.

Intent in a lot of cases is a judgement call by a jury. Really tough to have absolutes of intent of a person's judgement inside their brain in a split moment. I'm comfortable with common sense pointing all in one direction and charging him with some sort of negligence (even though a murder case isn't far fetched)
