On Aug. 4, the Patriot League sent a letter to Villanova stating that the conference denied McQuaide’s eligibility waiver request. the courts win pretty every time it's "NCAA vs courts" so not sure why the conferences would have a better leg to stand on?

That's because the NCAA never tells the courts "no". The same thing would happen there as will happen here. The conference will relent or get fined for violation of a court order, or worse.
