This is unfortunate. It sounds like a horrible night for the girl, for any number of reasons that may have nothing to do with JW.

You missed the point. They are unlikely to be able to uncover something that the state couldn't. The only reason you sometimes see civil trials end differently than criminal trials is because the burden of proof is different. It's not because the civil case uncovered some new and damning evidence.
This case doesn't have enough evidence to make it to trial. It's a dead duck.
