that's all you got? When and if it goes to a civil trial, then depositions will be taken and each and every person involved will be grilled by both attorneys. Sure if the evidence produces a guilty verdict, then yes, it's only monetary. But unlike the OJ Simpson trial, were he was found guilty in the civil suit AFTER the criminal suit, OJ could not be retried. And yes the DA can use evidence established in the civil trial in his decision to reopen the criminal charges.

Its problematic to take the 5th in a civil case. It opens you up to criminal prosecution, and contempt citations by the judge
